General Terms and Conditions
1. Introductory provisions
1.1. These General Terms and Conditions (hereinafter referred to as "GTC") regulate the legal relations between Rudolf Tengler - RTGPR (hereinafter referred to as "Provider") and its customers (hereinafter referred to as "Client") arising on the basis of ordering GPR and other services offered by the Provider.
1.2. The provider specializes in GPR surveys and geophysical measurements, especially in the areas of:
- searching for buried cellars, wells, underground passages and other cavities,
- routing of utilities (e.g. sewers, water pipelines, gas pipelines),
- location of archaeological objects and sites,
- detection of groundwater sources, fractures, caverns and other changes in the subsurface,
- searching for errant boulders, bedrock and other geological anomalies.
2. Conclusion of the contract and ordering of services
2.1. The contractual relationship between the Provider and the Client is established on the basis of a written or electronic order for services by the Client and its subsequent confirmation by the Provider.
2.2. The order must include:
- exact location of the area of interest (e.g. shared link from mapy.cz or drawing/plan),
- the subject of the survey (e.g. a buried well, utilities, cavities, etc.),
- the required extent and detail of the measurements (measurement grid and approximate area of the area of interest),
- other additional information (e.g. accessibility of the terrain, expected depth of exploration, etc.).
2.3. The client hereby confirms that he/she is the owner of the land on which the survey is to be carried out or that he/she has permission from the landowner to carry out the survey. The Provider shall not be liable for any disputes arising from non-compliance with this provision.
2.4. The Provider has the right to ask the Client to complete the order if the order is incomplete or contains incorrect information.
2.5. Upon confirmation of the order by the Provider, the order becomes binding.
3. Price and payment terms
3.1. All prices are approximate and without VAT. The final price for services is always determined based on the specific conditions and requirements of the Client.
- Survey with 0,5x0,5 m grid: 4-5 EUR/m².
- Survey with 1x1 m grid: 2-3 EUR/m².
- Survey with 2x2 m grid: 1-2 EUR/m².
- Price of transport: 0,5 EUR/km (the distance to and from is counted)
3.2. Unless otherwise agreed, payment is made after the survey is completed. The results of the measurements shall be forwarded to the Client only after payment has been received on the Provider's account.
3.3. The Client receives an indicative price offer from the Provider before the survey is started. The final price may be adjusted based on conditions found during the survey (e.g., terrain difficulty, change in survey area).
3.4. Payment for services is based on the invoice issued. The standard invoice due date is 14 days from the date of issue, unless otherwise agreed.
4. Obligations of the Provider
4.1. The Provider undertakes to perform the ordered services professionally, carefully and using professional methods and equipment.
4.2. The Provider is not responsible for inaccuracies caused by incorrectly entered data from the Client or unforeseen field conditions that may have affected the quality of the measurement.
4.3. The Provider shall inform the Client of the results of the measurements usually within 14 days of the completion of the survey, unless otherwise agreed.
5. Obligations of the Client
5.1. The Client is obliged to ensure the accessibility of the surveyed area (e.g. terrain passable for the mower, removal of major obstacles) and to warn the Provider of any obstacles that could complicate the survey.
5.2. The Client is obliged to provide the Provider with all available information about the area to be explored (e.g. the material used to fill the well, the existence of metal covers, the approximate depth of the line to be searched, etc.).
5.3. The client is obliged to pay the invoice on time.
6. Limitation of liability
6.1. The provider notes that some anomalies or objects may be difficult to detect (e.g. buried wells with the same material as the surrounding bedrock, utilities made of non-metallic materials - e.g. plastic pipe with water in bedrock with higher water content where the contrast of the materials is low -> difficult to detect).
6.2. Measurement outputs (e.g. radargrams, data evaluation) are provided as expert analyses with respect to available information and field conditions, while the accuracy of measurements may be affected by factors beyond the Provider's control.
6.3. The Provider shall not be liable for damages caused to the Client or third parties due to misinterpretation of data or use of measurement results without consulting an expert.
7. Cancellation Policy
7.1. The client can cancel the order at least 48 hours before the scheduled start of the survey without any cancellation fees.
7.2. In the event of cancellation of the order less than 48 hours before the start of the survey, the Provider has the right to charge the Client for the costs associated with the preparation of the survey or transport to the site.
8. Privacy Policy
8.1. The Provider handles the Client's personal data in accordance with applicable law (in particular the GDPR).
8.2. The Client's personal data is used solely for the purposes of contract performance and communication between the Provider and the Client.
8.3. The client has the right to request the correction or deletion of his/her personal data.
9. Final Provisions
9.1. These GTC are governed by the laws of the Czech Republic.
9.2. Any disputes between the Provider and the Client will be resolved primarily amicably, in the extreme case in the competent court of the Provider's registered office.
9.3. The Provider reserves the right to update these GTC at any time. The current version of the GTC is always available on the Provider's website.
